Pursuant to the earlier orders of this Court, today when the matter is called out, Mr. Jadhav, learned Counsel appears for the Petitioner and submits that the notice of withdrawal of the Election Petition as directed by this Court has been published in accordance with Section 110(3)(b) of the Representation of Peoples Act (the "Act") in the Official Gazette dated 23rd to 29th October, 2025, in the Free Press Journal dated 1st November, 2025 and Nav Shakti on 2nd November, 2025 and seeks to tender across the bar affidavit dated 8th December, 2025.

Mr. Karande, learned Counsel appearing for the Respondent No. 6 submits that he has also perused the said publications and that the 1/3

same are in order. Mr. Karande further submits that as directed by this Court by order dated 6th October, 2025, the Respondent No.6 has withdrawn the amount of costs.

Learned Counsel appearing in the matter submit that despite the publication, no request or application for substitution as party / Petitioner has been received under Section 110(3)(c) of the Act within 14 days of the said publication. The learned Court Associate also confirms the same. It is submitted that in this view of the matter, this Court may proceed in accordance with Sections 103 and 111 of the Act. 4.

I have heard the learned Counsel appearing in the matter. From a perusal of the affidavit of service dated 8th December, 2025, it emerges that although the Official Gazette publication in accordance with Section 110 (3) (b) of the Act has been effected on 23rd to 29th October, 2025, in Free Press Journal, (Mumbai Edition) on 1st November, 2025 and in the Nav Shakti on 2nd November, 2025 and we are on 8th December, 2025, no notice under Section 110 (3)(c) of the Act for substitution as party in place of Petitioner has been received within 14 days period despite elapse of the said period. 2/3

Accordingly, under Section 111 of the Act, Registry of this Court is directed to report this fact to the Election Commission of India. Further, in accordance with Section 103 of the Act, Registry is also directed to communicate the order dated 6th October,2025 permitting the withdrawal of the Election Petition as well as this order to the Election Commission of India as well as the Hon'ble Speaker of the Maharashtra Legislative Assembly.
