Mr. Bhutala, learned Counsel appearing for the Petitioner states that the Respondent No.1 has already filed the written statement. He states that the Respondent Nos. 2-Chief Election Commissioner of India and the Respondent No.3-The Returning Officer have not filed the written statement till date. He states that therefore, the order be passed that the matter should proceed without written statement against the Respondent Nos.2 and 3. 2.

Accordingly, the Election Petition shall proceed further without written statement of the Respondent Nos.2 and 3. Sonali

Mr. Kulkarni, learned Counsel appearing for the Respondent Nos.2 and 3 states that he has instructions to file the Interim Application seeking that the Respondent Nos.2 and 3 be deleted as parties in the Election Petition. He states that the said Interim Application will be filed within a period of two weeks from today. 4.
