The learned counsel for the Petitioner has placed on record an email communication which is duly acknowledged by the Respondent. She is directed to file appropriate Affidavit of service in terms of Bombay High Court Service of Processes by Electronic Mail Service (Civil Proceeding) Rule, 2017.

She would submit that it is not possible to issue notice to the Respondent on the address mentioned in the cause title as the office of Respondent No.1 is closed and this was so revealed when an attempt was made to serve private notice upon the Respondent. In such circumstances, she seek permission to serve the Respondent through substituted service by publication of notice in two widely circulated Newspapers in the area in which the office was being run, communicating the returnable date of the proceedings to be 21/01/2026.

924-ARBP--537-2025.odt The learned counsel for the Petitioner also expressed concern about the Laptop which was handed over to the Arbitrator during the course of proceedings, which was permitted to be used by the Petitioner as an employee of the Respondent and her concern is that the Arbitrator is seeking direction for return of the Laptop. In such circumstances, till the appearance of the Respondent, let the Laptop be returned by the learned Arbitrator to the Petitioner, who shall retain it in safe state.
