Having heard the parties for some time it is apparent that the parties have a legacy of having tested the Section 11 jurisdiction. 2.
By a detailed dated June 27, 2023, a Learned Single Judge of this Court relegated the Respondent to the Civil Courts based on objection to an arbitration raised by the Applicant in these proceedings. Today, it is the Applicant who seeks arbitration in connection with the another facet of the same agreement that was in dispute on the last occasion.
