At the threshold, it is submitted that the Original Petitioner in both the captioned proceedings has passed away and the legal heirs need to be brought on record. Learned Counsel for the parties jointly submit that all disputes and differences between them, covered by both the captioned proceedings, stand fully and finally settled in terms of the Consent Terms, executed copy of which is tendered across the bar. The same is taken on record and marked 'X' for identification. 3.

These consent terms fully and finally settle both the captioned proceedings. Consequently, all actions pursuant to the Consent Terms including release of the bank guarantee is hereby permitted. 4.

Learned Counsel for both the parties submit that there is nothing in the Consent Terms that is contrary to any requirement of law. 5.

The undertakings contained in the Consent Terms shall constitute undertakings given to the court. Both the captioned proceedings are finally disposed of in terms of the Consent Terms handed in.

All actions required to be taken pursuant to this order shall be taken upon receipt of a downloaded copy as available on this Court's website.
