The present petition is filed by petitioning creditor to declare Mr. Pulikot Sajith Menon, debtor as insolvent. On the last occasion, although the petition was served, but there was no appearance on behalf of the debtor and, therefore, the Court had directed the petitioning creditor to serve the debtor through WhatsApp and file an affidavit of service. 2.

Today, the petitioning creditor through Mr. Rajkumar Bajaj had filed an affidavit dated 03rd November, 2025 evidencing the service of the petition on the debtor through WhatsApp. However, there is no appearance today also on behalf of the debtor. Therefore, I have no other alternative but to allow the petition in terms of prayer clauses (a), (b) and (c). 3.

The Official Assignee to take charge of the properties of the debtor and any liquid amount recovered is to be invested in a nationalized bank.
