Not on board. Upon mentioning taken on board. At the outset, before the board was called, the Associate of this court had informed all the Advocates waiting in the court seeking circulation that only those matters which were extremely urgent were to be mentioned in terms of the notices published by this court. The advocates were also informed that in the event any matter was mentioned and it was found that the same was not urgent and contrary to the notices published, then not only would circulation not be granted but also costs be imposed and the matter would be listed after 6 months. The matter was mentioned at 10.30 a.m. when the Learned Counsel for the Petitioner tenders a preacipe, in which the reason for seeking urgent circulation

2/3 is mentioned as One of the legal heir is based in New Zealand and is in India until end of this month.

This court vide notice dated 17 th January 2025 published the following notice:

"IT IS HEREBY NOTIFIED for the information of the Advocates and the parties appearing in-person at the Principal Seat at Bombay that in continuation of Notice dated 3rd January, 2025, the Single Bench presided over by the Hon'ble Shri. Justice Arif S. Doctor has issued the following directions with effect from Monday, 20th January, 2025 A) INSTRUCTIONS FOR LISTING OF MATTERS:

(1) All fresh Miscellaneous Petitions for Heirship Certificate, Revocation of Grant and Judges' Order shall automatically be listed on assigned days on the 7th working day after office objections are removed and matters are numbered.

(II) Miscellaneous Petitions for Heirship Certificate, Revocation of Grant and Judges' Order, which are on lodging stage and pending as on date, shall also be listed automatically on assigned days on the 7th working day after office objections are removed and matters are numbered. B) The listing shall be in the chronological sequence of their filing / numbering.

C) There is no requirement to mention these matters for listing. Such requests shall not be entertained.

It is noted that the application for circulation was made despite the aforesaid notice as also the fact that there is absolutely no urgency in the matter.
