Mr. Dasgupta, learned Counsel appearing for the Petitioner submits that since the Suit proposed to be filed seeks a declaration that the gift deed dated 11th February, 2021 executed by the Defendant No. 2 in favour of the Plaintiff in respect of the certain flats is valid, subsisting and binding and that the gift deed dated 27th September, 2024 executed by the Defendant No. 2 in favour of the Defendant No.1 in respect of the very same premises is illegal, null and void, the Suit proposed to be filed is the Suit for land.

When it is pointed out to the learned Counsel that Clause XII leave is sought for and granted only when the part of cause of action arisen outside the jurisdiction of this Court and where a Suit is a suit for land, learned Counsel seeks to withdraw the Petition. 3.
