Interim Application (L) No. 42238 of 2025 :

Pursuant to the order dated 29th January, 2026, learned counsel for Defendant tenders a copy of Affidavit of Defendant stating that they have discontinued the use of the trade mark "QUIN" and they will withdraw the application for registration of the trade mark "QUIN". He submits that the Affidavit could not be e-filed. Time to e-file the Affidavit is extended till 16th March, 2026. Sairaj 1 of

Mr. Lokesh would further on instructions submit that as the Defendant does not intend to use the impugned mark "QUIN", the Interim Application may be allowed in terms of prayer clauses (a) and (b).

In view of the Affidavit of Defendant dated 12th February, 2026 coupled with the submissions, the Interim Application is allowed in terms of prayer clauses (a) and (b).

Leave Petition No. 252 of 2025 :

The Petition has been filed seeking leave under Clause XIV of Letters Patent (Bombay) for combining the cause of action of infringement of trade mark with cause of action for passing-off. 5.

There is no opposition to the said Petition.

Leave Petition is allowed.
