We have perused our order dated 10th December, 2025. Apparently, the statement recorded in paragraph no.2 of our order has turned out to be an eyewash. Considering the statement recorded in paragraph no.2, we had directed the Senior Auditor-cum-Deputy Director of Education, Mumbai, to complete the calculations and take a decision on 5th January, 2026 and make the payment within 30 days.

This matter is listed today for compliance. The learned AGP does not have instructions as to whether the said officer has
complied with our order. The learned AGP submits that the order has been complied with. We repeatedly requested the learned AGP to show us the calculations. However, she is not able to show the calculations on the ground that she has no instructions. She does not know the name of the officer against whom we would issue a suo motu contempt notice.

The learned AGP now submits that she will get the name of the officer and convey the same to the Court. 4.
After a pass over, when the matter was called out at 1:00 p.m., the learned Advocate for the Management submitted that all arrears were paid to the Petitioner in 2016-2017. Upon hearing this statement, the learned AGP submitted that revised pay fixation will have to be carried out by the Management so as to be submitted to the State Government, specifically to the Accounts Department of the School Education Department. Once such pay fixation is submitted, the Management will raise a bill according to the pay fixation and submit it to the Accounts Department. Thereafter, the calculations will be made, the bills will be cleared, and payments
will be made. This is being submitted on instructions from Mr. Sudhir Panindre, Senior Auditor and Mr. Rajesh Kankal, Deputy Director of Education.

We find from the statements recorded in the order dated 10th December, 2025, that on instructions it was informed to us that the calculation of the Petitioner's arrears was in progress with the State Authorities. Therefore, we had directed the concerned authority, namely, the Senior Auditor-cum-Deputy Director of Education, Mumbai, to complete the calculations and take a decision by 5th January, 2026, and to pass a reasoned order. We had further directed that the arrears be paid within 30 days thereafter. 6.
The statements recorded on 10th December, 2025, are diagonally opposite to the statements made before us today. 7.
List this Petition on 30th March, 2026 in the urgent admissions category, on which date, the two officers, namely Mr. Sudhir Panindre, Senior Auditor, and Mr. Rajesh Kankal, Deputy Director of Education, shall remain present in the Court hall
and explain why two contradictory statements have been made on different dates, particularly in the light of the Petitioner's claim that no payment has been made to her.
