This writ petition may not be maintainable against the respondent no.3 which is a co-operative society and therefore the petitioner-Company in order to avoid any technical objection has decided to institute a suit before a Civil Court of competent jurisdiction to challenge the impugned action of the respondent nos.1 and 2, more precisely to challenge the letter of termination dated 8th December 2025.

Mr. Rohit Upadhyay, the learned counsel for the petitionerCompany submits that with a view to approach the Civil Court, the petitioner-Company seeks permission of this Court to withdraw this writ petition with liberty to it to take appropriate legal recourse as available to it in law.
