Learned counsel for the petitioner fairly submits that pursuant to the notice issued by the SRA which is challenged in this writ petition, an order dated 17/04/2026 came to be passed. The petitioner has to challenge the order passed by the Slum

Bhogale 38.wp-1516-2026.odt Rehabilitation Authority ("SRA") taking a decision to acquire the property before the Apex Grievance Redressal Committee ("AGRC") under the Maharashtra Slum Areas (Improvement, Clearance and Rehabilitation) Act, 1971. In such view of the matter, the petitioner is permitted to withdraw this writ petition with liberty to approach the AGRC to challenge such order. All contentions in this writ petition are kept open to be raised before the AGRC.

It is made clear that we have not expressed any opinion on the merits of the rival contentions. In case the appeal is filed in which the application for stay is preferred by the petitioner, we request the AGRC to expedite the hearing of the application for stay preferably within a period of three weeks from the date of its filing.

The writ petition is disposed of as withdrawn with liberty aforesaid.
