We are informed by learned Counsel for the Respondent-SRA that the Chief Executive Officer has passed an order on the Section 13(2) proceedings whereby appointment of M/s. Sarathi Realty Builders and Developers was terminated as a developer and the Society is granted liberty to appoint a developer of its choice, as seen from the operative part of the order which is placed on record.

In this view of the matter, Mr. Khandeparkar, learned Counsel for the Petitioners seeks leave to withdrawn this Petition with liberty to the Petitioners to resort the appropriate proceedings as may be permissible in law. 3.

Allowed to be withdrawn with liberty as prayed for. 4.

The contentions of the parties on any such proceedings are expressly kept open.

Disposed of. No costs.
