2025.07.22 13:07:59 +0530 CHAITANYA ASHOK JADHAV WRIT PETITION NO. 1883 OF 2025 Ms Novex Enterprises ... Petitioners
Versus
The State of Maharashtra And Ors.
... Respondents ______________________________________________________ Ms Jyoti Chavan, Addl.G.P. (Video-Conferencing), for Respondent No.1.
______________________________________________________ CORAM : M.S. Sonak & Jitendra Jain, JJ.
DATED : 21 JULY 2025 PC:- 1.
This matter was called out on 07 July 2025, when neither any representative of the Petitioner nor their Advocates appeared.
2.
Therefore, we were constrained to make the following order :
"1. None for the Petitioner.
2.
Learned counsel for the Respondent also points out that the copy of the Petition has not been served on his office.
3.
With a view to grant the Petitioner an additional opportunity, we post this matter on 21
18-WP-1883-2025.DOCX July 2025, but under the caption 'for Dismissal/Disposal'.
4.
If on the next occasion, the same position continues, we will consider dismissing/disposing of this Petition in the absence of the Petitioner or their Advocate."
3.
Even today, the same position continues, since neither any representative of the Petitioners nor the Advocate appears. The Petitioners are not even bothered to serve a copy of this Petition on the Respondents.
4.
Accordingly, this Petition is dismissed for nonprosecution. Further, we find that the order impugned in this Petition is appealable, therefore, we clarify that dismissal of the Petition will not preclude the Petitioners from availing of the remedy of Appeal in accordance with law.
5.
All contentions of all parties are, however, left open. (Jitendra Jain, J) (M.S. Sonak, J)
