The learned advocate appearing on behalf of the Petitioner states that the Petitioner is not interested in litigating with the 1st Respondent, and hence, does not press the above Writ Petition in terms of prayer clause (a). All that the Petitioner seeks is a refund of the amounts paid by him to the 1st Respondent as more particularly set out in prayer clause b (i) as well as to direct Respondent No.1 to refund to the Petitioner the amounts incurred by the Petitioner to comply with the terms of the Agreement for development of JULY 9, 2025 Aswale

22.wp.1955.25.doc the Restaurant as prescribed in the Agreement. This figure is set out in prayer clause b (ii).

Mr. Samdani, the learned Senior Counsel appearing on behalf of the Airports Authority of India submitted that if prayer clauses b (i) and b (ii) are being pressed in the present Writ Petition, the Airports Authority of India requires some time to file an affidavit in reply. 3.

Acceding to Mr. Samdani's request,we direct that the affidavit in reply, if any, shall be filed on or before 30th July 2025. 4.

We now place the above matter on Board on 31st July 2025. 5.
