Ms. Chavan states that the department can have no objection to the revival/restoration of the Petitioner's Appeal. Ms. Chavan points out that under the Amnesty Scheme itself, there is a provision that the withdrawn Appeal would revive in case the Amnesty is not granted to the Applicant. 2.
Considering the statement made, we direct the restoration and revival of the Petitioner's Appeal No. MUMVAT-E-637/27890786177V/MVAT/233/2021-22/0004785995, before the Appellate Authority.

Mr. Raichandani states that with the above order, reliefs in this Petition stand substantially worked out. However, he
43-WP-2006-202.DOCX submits that the Petitioner challenge to the Notification dated 26 May 2017 may be kept open. Accordingly, we keep such challenge open to be raised before the appropriate forum and at the appropriate stage.

We also direct that this revived/restored Appeal should be disposed of expeditiously and in accordance with law. 5.
The Petition is disposed of in the above terms without any costs order.
