After this matter was heard for some time, the learned Counsel for the Petitioner, on instructions, seeks leave to withdraw this Petition with liberty to appeal against the impugned order.

The learned Counsel for the Petitioner states that appeal will be instituted within 6 weeks from today by complying with all requisite formalities. If the appeal is indeed instituted within 6 weeks from today by complying with all formalities, then, the appellate authority must decide the appeal on merits
