Heard the learned counsel appearing for the Petitioner. He would submit that Respondent was gainfully employed atleast since March 2022 and relies on statement issued by Employees State Insurance Corporation. He would submit that in the light of the clear evidence of employment of the Respondent, the Labour Court could not have ordered reinstatement with full backwages. He would however submit that Petitioner is open to payment of lumpsum compensation in lieu of reinstatement and backwages. Upon being queried about the quantum of compensation, he would take instructions from the authorized officer of the Plaintiff and submits that without prejudice to the rights and contentions of the Petitioner, an amount of Rs.5,00,000/- can be offered to the Respondent No.1 towards full and final settlement. katkam Page No.

Issue notice to Respondent No.1, returnable on 15 October 2025. In addition to Court notice, private service is permitted. 3.

Till the next date of hearing the impugned Award shall not be enforced subject to the condition of Petitioner depositing an amount of Rs.5,00,000/- in this Court within a period of four weeks. 4.
