The Petitioner's remedy is to approach the Maharashtra Administrative Tribunal for the reliefs prayed for in this Petition. Learned counsel for the Petitioner tried to submit that since it's a question of interpretation of service rules involved and as the Petitioner is more than 80 years of age, this Court should exercise its writ jurisdiction under Article 226 of the Constitution PMB

15-WP-2348-25.odt of India. Looking at the age of the Petitioner, it is open for the Petitioner to make a request to the Tribunal for expediting the Original Application, if filed which request obviously shall be considered on its own merits.
