....Petitioners

Versus

Municipal Corporation of Greater Mumbai & Ors.....Respondents ---- Mr. Sumit Kate a/w. Advocate Jenish Dinesh Jain for the Petitioners. Ms. Meena Dhuri i/b. Ms. Komal Punjabi for the Respondent - BMC.

Mr. Abhay Pednekar, Assistant Engineer Building and Factory Department, G/South Ward present.

---- CORAM : RAVINDRA V. GHUGE & ASHWIN D. BHOBE, JJ.

DATE : 8th SEPTEMBER, 2025 P.C. :- 1.

This matter was heard for some time in the first session. A pass over was granted to the learned Advocate for the Corporation to take instructions.

2.

We have perused the order passed by the learned Civil Court dated 14th February, 2025 in Notice of Motion No.844 of 2025 in Long Cause Suit No.5202 of 2024, by which, the Corporation was directed to pass a fresh speaking order after considering the reply or additional reply of the Plaintiff, within a period of one Gauri Gaekwad

6.WP-2693-2025.odt month. The learned Advocate for the Corporation submits, on instructions, that tomorrow, i.e., 9th September, 2025, the order would be passed.

3.

The grievance of the Petitioner is that on the adjacent land, a local politician, who is the son of a former MLA, has unauthorisedly erected structures on the Corporation land and is operating his office for his political activities from the said place. 4.

Considering the above, we direct the Corporation to ensure that the Competent Authority would pass a reasoned order within a period of three days, though it is stated that the order would be passed tomorrow, which shall be a well reasoned order. Let the Corporation decide the said issue independently, without being influenced by any person, no matter his high social status. 5.

With the above directions, this Petition is disposed off. (ASHWIN D. BHOBE, J.) (RAVINDRA V. GHUGE, J.) Gauri Gaekwad
