In this writ petition, petitioner, inter alia, seeks to quash and set aside the orders dated 1st July, 2025 and 2nd July, 2025 issued by the respondents by which the agreement executed in favour of the petitioner has been terminated and the petitioner has been blacklisted and the security deposit furnished by the petitioner has been forfeited. 2.

Learned counsel for the petitioner, after arguing the matter to some extent, seeks leave of this Court to withdraw the writ petition with the liberty to take recourse to the remedy of arbitration provided under Clauses 48 and 49 of the agreement. Learned counsel for the petitioner further submits

2-WP-2795-2025.doc that he be granted the liberty to move an application under Section 9/17 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as "the Act of 1996"). 3.

In view of aforesaid submissions, the writ petition is dismissed as withdrawn in terms of the liberty as prayed for. 4.

Needless to state that in case the petitioner files an application under Section 9/17 of the Act of 1996, the same shall be decided expeditiously.

It is made clear that this Court has not expressed any opinion on merits of the matter.
