P. C:- After the matter was heard for some time, Mr. Tamboly, the learned Counsel appearing on behalf of the Petitioner, seeks leave to withdraw this Writ Petition with liberty to challenge the Order dated 22nd May, 2025 passed under Section 3Z2 of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 (hereinafter S.R.JOSHI
8-wp-2877-2025.doc referred to as "the Slum Act"), the Order dated 10th July, 2025 passed under Sections 33 and 38 of the Slum Act and the Letter of Intent dated 2nd May, 2024.
Leave, as sought for, is granted. The Writ Petition is disposed of as withdrawn Mr. Balsara, the learned Counsel appearing on behalf of Respondent No.49 pt, states that he would have no objection if all these Appeals are filed before the AGRC.
All these Appeals will be filed before the AGRC within a period of three weeks from today.
The AGRC shall decide the said Appeals within a period of six weeks thereafter.
Till the disposal of the Appeals and for a period of three weeks thereafter, the concerned Authority will not demolish Petitioner's structure.
The aforesaid directions are without prejudice to the rights and contentions of the parties.
It is made clear that this Court has not gone into the metis of the matter.
