The petitioner, who is a senior citizen aged 81 years, claims that there is Permanent Alternate Accommodation Agreement entered by the developer with the petitioner and accordingly, there is no dispute in regard to the entitlement of the petitioner to the permanent alternate accommodation. However, it is the petitioner's case that respondent no. 7 is illegally occupying the tenement which is allotted to the petitioner.

Learned counsel for the MHADA would take instructions whether such contention of the petitioner is correct. If it is correct, then immediate action would be required to be taken by the Executive Engineer to evict the illegal occupant and grant the occupation of the tenement to the petitioner. 3.
