Mr. Tamboly, learned counsel for the Petitioner informs that the Petitioner has an equally efficacious alternate remedy of filing an Appeal before the Appellate Authority constituted under Section 70 of Maharashtra Housing And Area Development Act 1976, hence the Petitioner be permitted to withdraw the petition with liberty to pursue all contentions in the Appeal. Allowed to be withdrawn with liberty as prayed for. Let the appeal be filed within one week from today. If the Appeal is filed, let the same be decided in three months.

All the contentions of the parties are expressly kept open. Disposed of. No costs.
