The proceedings are listed today for compliance of the order dated 14 July, 2023 passed by the Maharashtra Real Estate Regulatory Authority, Mumbai and the order dated 16 July 2025 passed by a co-ordinate Bench of this Court on the present petition. An affidavit of Mr. Manish Adhikari, Constituted Attorney of the sole proprietor of the petitioner, is placed on record to submit that an amount of Rs.32 lakhs, which was due on 30 September, 2025, was paid to respondent no. 3 on 3 October, 2025 and the last tranche of Rs.34,57,601/- shall be disbursed by the petitioner to respondent no. 3 before 31 October, 2025. We accept the affidavit of the petitioner as undertaking to the Court.

At this stage, we are informed that there was a delay of 3 days in making payment of Rs.32 lakhs. As the amount of Rs.32 lakhs is already paid to respondent no. 3, we condone the delay of 3 days in making such payment. However, there ought not to be any further default in making payment of last tranche of Rs.34,57,601/-, which is to be paid on or before 31 October, 2025. 3.
We adjourn the proceedings to 4 November, 2025 for recording the final compliance.
