As the petitioner was bonafide pursuing this Petition, if the appeal filed within one week from today, the same be decided on its merits without an objection as to limitation. All contentions of the parties on the proposed proceedings are kept open. 5.

We are informed that there is a recovery notice. If the petitioner files the Appeal and if the same is served on the Department on the very same day, the recovery notice issued to the Petitioner shall not acted upon.
