1) Considering the position that the deducted amount forms part of two punishments imposed on the Petitioner in the disciplinary proceedings, I do not find any fault in the findings recorded by the Presiding Officer of Labour Court holding that the issues raised by the Petitioner requires adjudication and cannot be decided under Section 33(C-2) of the Industrial Disputes Act. Similar is the position in respect of Petitioner's demand for promotion after the treatment of suspension period as period spent on duty. Even this aspect requires adjudication. In that view of the matter, no interference is warranted in the impugned order. The petition is dismissed.
