On merits, we do not find any reason to entertain this writ petition seeking restraint order against the Brihanmumbai Municipal Corporation (BMC) to issue the Occupancy Certificate to the project of M/s. ACME Metal Industries Private Limited. There is no pleading in this writ petition and no reference to any provision of law except stating that the respondent no. 2 was required to take permission under section 8 of the Maharashtra (Urban Areas) Protection and Preservation of Trees Act, 1975 before cutting the trees.

With the aforesaid observations, Writ Petition No. 3396 of JAYANT VISHWANATH SALUNKE 2025 is dismissed.
