This petition under Article 226 of the Constitution of India is filed praying for multiple reliefs. However, for the purposes of adjudication of the present writ petition, as agreed by the learned advocate for Petitioner, the Petitioner confines the relief as prayed for in prayer clause (a), which reads thus: "a. This Hon'ble Court to issue writ of mandamus or writs of certiorari to direct the Defendant no.1 to issue LOI/IOA/CC for SRA project at Malad west in the name of petitioner." 2.
It is the Petitioner's contention that the Respondent no.1 i.e. Slum MANISH SURESHRAO THATTE Date: 2026.01.29 10:09:58 +0530 MANISH SURESHRAO THATTE Rehabilitation Authority (SRA) be directed to issue Letter of Intent (LOI), M.S.Thatte
19.WP.3498.2025.DOC Intimation of Approval (LOA) and Commencement Certificate (CC) for the slum rehabilitation project of the Petitioner namely Panchsheel SRA Co-operative Housing Society Limited, which is situated at CTS No.227/15 of village Malad, Taluka Borivali, District Mumbai ('SRA project'). 3.
In our opinion, considering the limited relief that the Petitioner seeks in the petition and although there being no written opposition/reply of the Respondents, considering the nature of the orders we propose to pass, no prejudice would be caused to the Respondents. The following order would serve the ends of justice :-
ORDER
(i) Respondent no.1 Slum Rehabilitation Authority shall consider and decide the issue regarding grant of Letter of Intent (LOI), Intimation of Approval (IOA) and Commencement Certificate (CC) for the SRA project of the Petitioner in accordance with law, as expeditiously as possible, preferably within a period of six weeks from the date this order is made available to the said Respondent by the Petitioner;
(ii) Let all parties be heard;
(iii) All rights and contentions of the parties, especially of the Respondent no.3 are expressly kept open. We expressly make it clear that we have not dealt with any rival contentions of parties on merits; (iv) Writ Petition is disposed of in the above term. No costs. (AARTI SATHE, J.) (G. S.
