This petition under Article 226 of the Constitution of India is filed praying for the following substantive reliefs:- "(a) This Hon'ble Court may kindly be pleased to issue a Writ of Mandamus, and/or any other Writ, Order or Direction in the nature of Mandamus or Certiorari or Order Quashing & setting aside the Seizer Memo DIN No. 202405790B000000D7ED PCG-A 01/2024 dated 24.05.2024 of Watch of Mont Blanc make, 1858 model as Iced Sea bearing Sl. No. 130793 as Exh.H6 herein above; (b) This Hon'ble Court may kindly be pleased to issue a Writ of Mandamus, and/or any other Writ, Order or Direction in the nature of Mandamus or Certiorari or Order Quashing and setting aside the Show Cause Notice no. C-815/2024 dated 3.6.2024 vis-a-vis Watch of Mont Blanc make, 1858 model as Iced Sea Sl. No. 130793, in the file of Respondents more particularly in the file of Respondent no. 7 as Exh.I hereinabove."

On the earlier occasion, we had passed an order that the show cause notice dated 03 June 2024 issued to the petitioner needs to be taken to its logical conclusion. We had also observed that, in the facts and circumstances of the case, 15 April 2026
3-WP 3688-25.DOC and considering the value of the watch, provisional release of the watch could be permitted, on the petitioner furnishing a bond to make payment of duty, in the event the show cause notice is decided against the petitioner. It has now been informed to us by Ms. Maya Majumdar, learned counsel for the respondents/ Department, that the Department is in the process of releasing the wrist watch in favour of the petitioner.

However, in the meantime, upon the petitioner producing the relevant documents, by a reasoned order dated 09 April 2026 passed by Shri. Deepak Doke, Assistant Commissioner of Customs, PCG A, CSMI Airport, Mumbai, the proceedings initiated against the petitioner vide Show Cause Notice dated 03 June 2024 have been dropped. The seized wrist watch, having been held not liable for confiscation, is ordered to be released to the petitioner, if not already provisionally released. A copy of the said order is placed on record. 4.
In this view of the matter, further adjudication of this petition is not called for. We accordingly dispose of this petition, leaving the respondents to comply with the earlier order passed by this Court to release the wrist watch and now unconditionally as per order dated 09 April 2026 (supra), which be complied with within a period of one week from today.
