ORDINARY ORIGINAL CIVIL JURISDICTION WRIT PETITION NO. 3848 OF 2025 Madan Mohan Lal Chhabra & Ors

...Petitioners

Versus

State of Maharashtra & Ors

...Respondents

Ms Lopa Munim, i/b Vivek Sawant, for the Petitioners. Ms Anupama Pawar, AGP, (appeared online), for the RespondentState. Adv Enait Shaikh i/b Sandeep Chopra, for Respondent No. 3.

CORAM:

SUMAN SHYAM & M. M. SATHAYE, JJ.

DATED:

25th NOVEMBER, 2025.

PC:- SHEPHALI SANJAY MORMARE 1.

This Writ Petition has been filed with the primary grievance by SHEPHALI SANJAY MORMARE Date: 2025.11.27 10:35:54 +0530 that the complaint lodged by the the Petitioners before the Respondent No. 2 on 10th October 2024 has not been acted upon till date without any valid reason. After noting the grievances expressed by the Petitioner, this Court had passed order dated 3rd October 2025 and, thereafter, again on 15th October 2025 requiring the learned Additional Government Pleader to obtain instructions. 2.

Today when the matter was called out, the learned AGP appearing for the Respondent-state has produced a copy of the order dated 24th November 2025 passed by the Respondent No. 2 informing the Petitioners that the Show Cause Notice earlier issued 25th November, 2025

51-WP-3848-2025.DOC on the basis of the complaint dated 10th October 2024 has been withdrawn. The Petitioners' counsel, however, submits that the order dated 24th November 2025 does not indicate as to the outcome of the complaint filed by the Petitioners on 10th October 2024.

3.

After going through the order dated 24th November 2025, we are unable to accept such submissions of Ms Lopa Munim. Rather, we are of the view that by the order dated 24th November 2025, the Respondent No. 2 has effectively held that the complaint dated 10th October 2024 was devoid of any merit and, accordingly, has closed the matter. Therefore, the complaint must be treated to have been disposed of.

4.

If the Petitioners are aggrieved by the order dated 24th November 2025, it will be open for them to assail the same by filing appropriate Petition.

5.

This matter is, therefore, adjourned to 9th December 2025, so as to enable the learned counsel appearing for the Petitioners to obtain updated instructions in the matter.
