The Petitioner has preferred this Petition under peculiar circumstances. The Petitioner suffered a departmental enquiry on the ground of alleged misconduct. In the criminal trial, the concerned Court delivered a judgment on 2nd January, 2017 in Criminal Case No. PW/2104/1996, and the Petitioner was acquitted. However, the Enquiry Officer held the charges proved in the departmental enquiry. Thereafter, the Petitioner raised an industrial dispute, and a reference was made to the Central Government Industrial Tribunal (CGIT) No.2, bearing No. 16 of ...1
2021, on 18th October 2021. Due to a vacancy that arose in the office of the Presiding Officer, CGIT No.2, Mumbai, the charge of CGIT No.2 was handed over to the CGIT at Nagpur. However, CGIT No.1 has recently been appointed and is likely to take charge within 2 to 3 days. 2.
In view of the above, and by consent of the learned Advocates for Respondent No.1 as well as Respondent No.2, we accede to the request of the Petitioner that his proceedings bearing No. 16 of 2021 be transferred to CGIT No.1 at Mumbai. The Registry of the CGIT 2, at Mumbai, will accordingly take necessary steps.

Considering the pendency before CGIT No.1, and keeping in view that the Petitioner was terminated from service by order dated 31st March 2006, we request CGIT No.1, Mumbai, to expedite the hearing in the matter, keeping in view that the Petitioner has been out of employment for the last 19 years, and to decide the proceedings as expeditiously as possible, in any case, on or before 31st December, 2026. 4.
Parties to the proceedings are expected to render wholehearted cooperation to the Tribunal.
