1) It is the settled position of law that a writ petition against private individuals is ordinarily not maintainable, as such persons do not fall within the ambit of Article 12 of the Constitution of India. 2) The present Petition is wholly misconceived inasmuch as it seeks reliefs, including a writ of mandamus, against private individuals. In these circumstances, the Petition is not maintainable in writ jurisdiction. In our view, the filing of the present Petition constitutes a patent abuse of the process of law. The Petition is accordingly dismissed in limine with costs quantified at Rs.25,000/-.
