A set of private individuals have entered into a settlement with a Private College. Now the grievance is that the college played a fraud and fraudulently got the settlement signed. Fraud, coercion, threat, pressure and misrepresentation, was practiced by the Private College. Pre-consent was not obtained. 2.
We expressed our disinclination in the light of Article 12 of the Constitution of India. A private settlement between two SUNNY THOTE

The learned Advocate for the Petitioners submits that the Petitioners would withdraw this Petition and avail of a remedy, as is permissible in law, by approaching the competent Civil Court for seeking quashing of the agreement.

In view of the above, this Writ Petition is disposed off as withdrawn, on instructions. If the Petitioners avail of a remedy of approaching the Civil Court, the withdrawal of this Petition would not be an impediment and all contentions of all the stakeholders are kept open.
