The Advocate for the Petitioner, on instructions, seeks leave to withdraw the Writ Petition and to proceed before the Maharashtra Revenue Tribunal (MRT), with a request that the contention of limitation may not be pressed by the Respondents before the Authority.

In response, the Advocate for the Respondents submits that, in any event, Section 14 of the Limitation Act would come to the aid of the Petitioner, and the authority may decide the issue on its own merits.

The authorities may consider the point of limitation sympathetically as the time was consumed by the Petitioner in prosecuting the present Petition but shall do so in accordance with law and on its own merits.

The MRT shall attempt to dispose of the Appeal preferably within a period of six months.

All concerned to act on an authenticated copy of this order. 6.

It is clarified that this Court has not examined the merits of the matter and all contentions of both the parties are expressly kept open.

In view of the disposal of the Appeal, Interim Application stand disposed of.
