This is one more example of the Municipal Corporation of Greater Mumbai practically ignoring the order of the High Court and showing scant respect. The learned Single Judge has passed an order on 5th August, 2024 in First Appeal No.527 of 2018, recording that the Corporation has initiated action against unauthorized construction and it would be open for the Appellant to adopt appropriate remedies in the event the order passed by the Corporation is adverse to the Appellant.

The learned Advocate for the Corporation has shown us a document with the title 'Speaking order dated 10th August, 2024'. Besides passing an order, which appears to be cryptic, no further steps have been taken to demolish the structure, though it is only mentioned in the operative part that if the structure is not demolished by the concerned person, it will be demolished by the office of the Assistant Commissioner, Designated Officer, 'A' Ward, Municipal Corporation of Greater Mumbai. Nothing has been done in this regard.

The Assistant Commissioner, Designated Officer, 'A' Ward, Municipal Corporation of Greater Mumbai, shall remain present in the Court tomorrow, i.e., on 24th December, 2025 and explain his conduct, failing which, we would be compelled to issue notice to the Commissioner of the Municipal Corporation. 4.

List this Petition on 24th December, 2025, in the 'Urgent Supplementary Board'.
