On 23rd December 2025, we had passed following order : "1.
This is one more example of the Municipal Corporation of Greater Mumbai practically ignoring the order of the High Court and showing scant respect. The learned Single Judge has passed an order on 5th August, 2024 in First Appeal No.527 of 2018, recording that the Corporation has initiated action
against unauthorized construction and it would be open for the Appellant to adopt appropriate remedies in the event the order passed by the Corporation is adverse to the Appellant.

The learned Advocate for the Corporation has shown us a document with the title 'Speaking order dated 10th August, 2024'. Besides passing an order, which appears to be cryptic, no further steps have been taken to demolish the structure, though it is only mentioned in the operative part that if the structure is not demolished by the concerned person, it will be demolished by the office of the Assistant Commissioner, Designated Officer, 'A' Ward, Municipal Corporation of Greater Mumbai. Nothing has been done in this regard.

The Assistant Commissioner, Designated Officer, 'A' Ward, Municipal Corporation of Greater Mumbai, shall remain present in the Court tomorrow, i.e., on 24th December, 2025 and explain his conduct, failing which, we would be compelled to issue notice to the Commissioner of the Municipal Corporation. 4.
List this Petition on 24th December, 2025, in the 'Urgent Supplementary Board'.

Today the concerned Officer Mr. Jaydeep More, Assistant Commissioner, Designated Officer, A-Ward, Municipal Corporation of Greater Mumbai, is present in the court hall. The learned Advocate for the Corporation has no explanation to give to us as to why action was not taken in the light of the speaking order dated 10.8.2024, by virtue of
which the proceedings before the learned Single Judge (First Appeal No. 527 of 2018) was withdrawn as a speaking order was to be passed. It is informed to us that inadvertently the order could not be complied with. 3.
In view of the above, we direct the Municipal Commissioner of the Corporation to initiate appropriate action against above named officer Mr. Jaydeep More, for having failed in performance of his duty. In the interregnum, the Corporation is at liberty to comply with the decision taken vide order dated 10.8.2024. 4.
This Petition is disposed off.
