Perused Petition. Petitioner No. 2 is the nephew of the deceased(Class-II, entry(IV)), whereas the petitioner no. 1 is the brother of the deceased(Class-II, Entry-(II)). The father of the petitioner No. 1 Vinodchandra is predeceased to the deceased, hence, as per Sec. 9 of the Hindu Succession Act, 1956, petitioner No. 1 has the preference than the the descendants of the Vinodchandra. Hence, the petitioner to satisfy that the petitioner No.2 has the capacity to present the petition. Furthermore, petitioner to state about the marital status of the Samir.
