Advocate for petitioner has filed praecipe dated 09.05.2025 seeking exemption of court fees in the present petition as court fees has already been paid in TP No. 3431 of 2024.
2. The present petition is filed for Letters of Administration of the property and credits of Bhadresh Sanalal Shah by petitioners namely Bhairav Haresh Shah and Pooja Ajay Rao being nephew and niece of deceased. Para No. 8 of the petition states that another petition No. 3431 of 2024 is filed for Letters of Administration of property and credits of Bhadresh Sanalal Shah by petitioner namely Manisha Haresh Shah being sister of deceased and the said Letters of Administration is granted on 25.10.2024. Copy of grant is annexed to the petition as Exhibit - "D".
3. The properties mentioned in both the petitions are same and identical. Para No. 8 of the petition states that though the grant was issued to Manisha Haresh Shah and she died on 24.10.2024 without administering the estate of deceased. The court fees of Rs.75,000/- has already been paid in TP No. 3431 of 2024 as stated in para No. 9 of the petition.
4. In view of the above, the present petition is covered under section 23 of the Maharashtra Court Fees Act, 1959 and petitioner is entitled for exemption of court fees in the present petition. The said praecipe is disposed. 17.06.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
