1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Altaf Virani Altaf T Virani being son of deceased. Deceased No. 1 namely Malek Sultan Virani died intestate at Hyderabad on 04.12.2016. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Election Card is already annexed to the petition. Deceased No. 2 namely Daulat Virani died intestate at Mumbai on 24.12.2006. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 03.10.2024 for non-availability of identification proof of deceased No. 2. The same is accepted.

2. Ld. Advocate for petitioner submits that parents of deceased No. 1 predeceased the deceased. Husband of deceased No. 1 died on 22.05.1987. Deceased No. 1 was survived by one son who is petitioner herein. Parents of deceased No. 2 predeceased the deceased. Deceased No. 2 died as spinster. The brother of deceased No.2 died leaving behind one son. Deceased No. 2 was survived by one nephew who is petitioner herein. There are no other legal heirs. The securities mentioned in the Schedule are jointly held by deceased Nos. 1 and 2.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 21.02.2025 is filed. Delay is explained and same is condoned. As sole surviving legal heir of the deceased is petitioner before this Court and the right or interest of no other legal heir is required to be protected. Hence, Administration Bond is dispensed with. All other legal formalities are complied with. Hence, petition is granted.

4. Office to issue Succession Certificate as prayed after verifying whether any cross petition is filed or whether any Affidavit opposing grant is filed. 30.03.2026 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
