1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Sunil Kumar Jain being Executor named under the Will of deceased. The deceased namely Akal Kumari died at Bankok, Thailand on 09.01.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Jaipur, Rajasthan on 22.03.2019. The said Will is in Hindi language and Advocate's translation is annexed to the petition however, Affidavit of Advocate on record certifying that the said translation is true and correct is not filed. The last para of page No. 11 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. Residuary clause in respect of properties of deceased is mentioned at para No. 7 of the Will.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Deceased is survived by one son and three daughters. Out of them son is petitioner herein and three daughters have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavits of Rajiv Kumar Jain and Prakash Jangir dated 06.12.2025 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 17.03.2026 is filed. Delay is explained and the same is condoned.

5. However, statutory period of service of citation not yet completed hence, matter is adjourned to 21.04.2026.
