TP/943/2025 (E-filing) Mr. Jayant Wani i/b. Lakdawala and Co., Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Bhupesh Babubhai Negandhi being sole Executor named under the Will of deceased. The deceased namely Jyoti Jaisingh Ashar died at Mumbai on 15.04.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.
2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 31.01.2022 and the same is registered on 04.02.2022. The said Will is in Gujarati language and official translation of the said Will is not uploaded on the official portal of the Bombay High Court. The Para No. 7 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.
3. Ld. Advocate for petitioner submits that parents, parents of husband of deceased and husband of deceased predeceased the deceased. Deceased died issue-less. Husband of deceased had two sisters and five brothers. Three brothers of deceased died and their legal heirs are mentioned in para No. 8 of the petition. Therefore, deceased was survived by five sisters-in-laws, two brothers-in-laws, five nephews who all have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.
4. Petitioner's oath is filed. Affidavit of Maitri Hemanshu Dhruv dated 13.01.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 21.03.2025 is filed.
5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant.
