TP/946/2025 (E-filing) Mr. Dhruv Malhotra, Advocate for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Arvind Kashinath Dongre being sole Executor named under the Will of deceased. The deceased namely Kashinath Savalaram Dongre died at Mumbai on 24.05.2017. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.
2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 10.09.2013. The said Will is in Marathi language and translation of the said Will is annexed to the petition. Affidavit of Advocate for the translation of the Will certifying that the true and correct translation of the said Will is not filed. The Para No. 8 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will.
3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased was survived by two sons and two daughters. Out of them one son is petitioner herein and another son and two daughters have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.
4. Petitioner's oath is filed. Affidavits of Vrushali Raghunath Damle and Karuna Nikesh Ghate dated 27.12.2024 and 30.12.2024 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation is not properly filed.
5. Ld. Advocate for petitioner seeks directions to issue fresh General Citation. Office to issue fresh citation, if not already issued.
6. Ld. Advocate for petitioner file praecipe to place on board as ad when all compliance is done in this matter.
