Ld. advocate for the petitioner submitted that as per the averments in the petition, the petitioner is sole surviving legal heirs of the deceased as per Sec. 55 of the Indian Succession Act, 1925.

Ld. advocate for the petitioner submitted that the properties mentioned in the present petition, is not subject matter of the Will for which probate has been obtained in the TP No. 3379 of 2021.

However, upon perusal of the Will's Paragraph No. 11, it appears that testatrix has made provision about the residual property by dividing it into 08 parts.

Hence, the petitioner to explain that this property does not form the part of residue of the testatrix property.
