TP/981/2025 (E-filing) Mr. Niket Jani i/b. Jani and Parikh, Advocate for petitioners PC : 1. Perused Petition. Heard Ld. Advocate for petitioners. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Priyahas Anantkumar Jani, Nirav Jani and Kalyani Jani being Executors named under the Will of deceased. The deceased namely Kokila Anantkumar Jani died at Mumbai on 11.10.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 26.01.2022. The said Will is in Gujarat language and official translation of the said Will by Chief Translator is filed separately through e-filing. The Para No. 3 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will who are petitioners herein.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Son of deceased namely Chandrahas Jani predeceased the deceased who died leaving behind his widow, one son and one daughter. Deceased was survived by one son, one daughter, one daughterin-law, one grandson and one granddaughter. Out of them son, daughter and grandson are petitioners herein and the daughter-in-law and granddaughter have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Anand Mamraj Agarwal dated 13.01.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 16.04.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
