TP/1005/2025 (E-filing) Mr. Madhusudan Gawde, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Mehernosh Faramroz Behramkamdin being son of deceased. Deceased namely Roshan Farmroz Behramkamdin died intestate at Mumbai on 20.05.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition.

2. Ld. Advocate for petitioner submits that husband of deceased died on 25.09.2015. Deceased has one son and one married daughter. Son is petitioner herein. Married daughter namely Ketayoun and her husband namely Kersi died on 26.12.2004. She had two sons. Out of that one son namely Anosh Kersi Fouzdar is declared presumed to be dead by an order dated 04.04.2016 in Misc. Petition No. 29 of 2016 in TP No. 1915 of 2015. Another son namely Farzan Kersi Fouzdar has filed his consent Affidavit in favour of petitioner herein. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 18.03.2025 and Administration Bond dated 22.03.2025 are filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.
