TP/1017/2025 (E-filing) Mr. R. T. Kharwar i/b. Sucit C. Panchal, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Rapheal Ivan Jesson being sole Executor named under the Will of deceased. The deceased namely Ashok Krishnarao Hebale died at Mumbai on 25.11.1995. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 24.12.2024 for non-availability of identification proof of deceased. The same is accepted.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 10.05.1995. The said Will is in English language. The Para No. 2 of the Will states that the beneficiaries will act as Executors. As per para No. 7 of the Will, the petitioner is the only surviving beneficiary. Out of them wife of deceased namely Neita died on 12.02.2001. Hence, as per para Nos. 2, 3 and 7 of the Will, deceased had appointed one executor who is peetitioner herein. Residuary clause in respect of properties of deceased is mentioned at para No. 10 of the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Widow of deceased since deceased the deceased. Deceased was survived by one step son and two step daughters. Out of them step son is petitioner herein and both the steps daughters have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Helan Charles dated 24.12.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 21.04.2025 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
