Petitioner to correct the second date and amount and file same for gross amount as per form no. 118 r/w Rule 420 of the Bombay High Court ( O. S.) Rules, 1980. Furthermore, corrections must be initialed by the petitioner, surety and notary. 2.

Petition is filed for grant of Letters of Administration of the properties belonging to Melville Austin Vedamuthu alias Mr. Melville Austin Vedamuthu alias Melville A. Vedamuthu alias Shn. M. A. Vedamuthu. The petitioner No. 1, 2 and 3 are widow, daughter and power of attorney of the daughter of the deceased, respectively. The daughter of the deceased, namely Mrs. Asha Clarine D'souza, is the presented the petition along with her mother as heir of the deceased as well as a attorney of absent heir, vide Sec. 243 of the Indian Succession Act, 1925 (for short "IS Act").

In view of Sec. 243 of the IS Act, attorney can present the petition, where no legal heir/s is willing to administer the property. Hence, in presence of the Petitioner No. 1 and 2, this condition is not fulfilled. Hence, the petitioner No. 3's name to be deleted or Clive Samuel Vedamuthu a daughter of the deceased, may join as a petitioner to the petition. In such circumstances, the petitioners to take steps for amendment.
