TP/1088/2025 (E-filing) Mr. Atul Mody, Advocate for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Kishore Jhamandas Advani and Vishesh Dhirendra Sangoi being Executors named under the Will of deceased. The deceased namely Jagdish Jhamandas Advani died at Mumbai on 12.11.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 21.08.2019. The said Will is in English language. The Para No. 12 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who both are petitioners herein.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. First wife of deceased died on 17.12.1996. Thereafter, deceased re-married to Disha. Deceased had two sons from the first marriage. Ld. Advocate for petitioner further submits that deceased do not have any issue from the second wife therefore, as stated in para No. 8 of the petition, deceased was survived by second wife and two sons who all have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Nimesh Kishore Advani dated 03.01.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 27.03.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
