TP/1113/2025 (E-filing) Ms. Bina S. Shivhare, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. Ld. Advocate for petitioner has filed praecipe for refund of excess court fees paid in this matter. Ld. Advocate states that the petitioner is son's widow and daughter-in-law of deceased.

2. In para No. 4 of the petition, petitioner is shown as widow of Chetan Pandurang Chavan. The said Chetan Pandurang Chavan, son of deceased died on 26.01.2020. Since, petitioner is widow the Ld. Advocate for petitioner states that the Notification dated 09.08.2024 is applicable to the petitioner in the present case and she also refers to the order dated 09.04.2025 passed in MPT No. 108 of 2025 wherein para No. 3 of the said order clearly states that the said Notification will apply to all the widows in cases of Application for Probate, Letters of Administration, Succession Certificate and Legal Heirship Certificate irrespectively.

3. In view of the above, petitioner is entitled for refund of court fees of Rs.65,000/- as the petitioner has already paid Rs.75,000/- court fees and as per the said Notification the court fees payable by widow is Rs.10,000/- only.

4. Office is directed to issue refund certificate of Rs. 65,000/- to the petitioner herein. Praecipe filed by the Advocate for petitioner is disposed off. 06.05.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
